Continuation of Documentation for TPS Beneficiaries for Six Countries; Documents Auto-Extended Through Oct. 4, 2021

The Department of Homeland Security (DHS) announced a Federal Register notice extending the validity of Temporary Protected Status (TPS)-related documentation for beneficiaries under the TPS designations for…

  1. El Salvador
  2. Haiti
  3. Honduras
  4. Nepal
  5. Nicaragua
  6. Sudan

The notice automatically extends through Oct. 4, 2021, the validity of Employment Authorization Documents (EADs); Forms I-797, Notice of Action; and Forms I-94, Arrival/Departure Record (collectively, TPS-related documentation) for beneficiaries under the TPS designations for these six countries. The Notice also provides instructions to request a new EAD for beneficiaries who want a new EAD with an Oct. 4, 2021, expiration date.

DHS is extending the TPS documentation in compliance with the preliminary injunctions of the U.S. District Court for the Northern District of California in Ramos et al. v. Nielsen et al. and the U.S. District Court for the Eastern District of New York in Saget et al. v. Trump et al., and with the order of the U.S. District Court for the Northern District of California to stay proceedings in Bhattarai v. Nielsen.

Completing Form I-9

When you are completing or updating Form I-9, Employment Eligibility Verification, follow the chart below to determine which documents a current TPS beneficiary from these countries may present, as well as the new expiration date of their automatically extended EAD:

If the employee’s EAD has category code of A-12 or C-19 and a Card Expires date of: Enter the new expiration date of the employee’s automatically extended EAD on Form I-9:     You must reverify the employee before they start work on:
