DHS extends TPS protection through December 31, 2022

On September 10th, 2021, the Department of Homeland Security (DHS) published a Federal Register notice announcing that beneficiaries under the following six (6) Temporary Protected Status (TPS) designations for will retain their TPS while the preliminary injunction in Ramos remains in effect, provided their TPS is not withdrawn because of individual ineligibility.

When completing or updating Form I-9, Employment Eligibility Verification, follow the chart provided to determine which documents a current TPS beneficiary from these countries may present, as well as the new expiration date of their automatically extended EADs

The I-766 / Employment Authorization Document (EAD) must have a category code of A-12 or C-19 and have one of the expiration dates listed in the chart below.

  1. El Salvador
  2. Haiti
  3. Honduras
  4. Nepal
  5. Nicaragua
  6. Sudan

In compliance with the injunction, DHS has automatically extended the validity of Employment Authorization Documents (EADs) and other TPS-related documentation for TPS beneficiaries affected by the injunction through December 31, 2022.

DHS has provided a list of eligible EAD expiration dates below issued to beneficiaries under the TPS designations. Each one of these expiration dates has been extended through December 31, 2022. A beneficiary under the TPS designation for any of these countries who has applied for a new EAD but who has not yet received it is covered by this automatic extension, provided that the EAD he or she possesses contains one of the expiration dates below.
